The
Sworn Translation is usually required for documents requested in legal processes or in documents that must be attested by an authority, e.g.: process records, PoA’s, financial statements, articles of incorporation, etc.
Art. 13 of the Constitution from 1988 asserts that “Portuguese is the official language of the Federative Republic of Brazil.” For that reason, the Civil Code establishes on its Art. 140 that “The legal writings presented in a foreign language must be translated into Portuguese to be legally valid within the country.” And it is read, in the Code of Civil Procedures, Arts. 156 and 157 that “In all acts and terms of the process, the use of the national language is mandatory” and that “Documents produced in a foreign language may only be joined to the records when followed by its version, translated into the national language and signed by a sworn translator.”
In compliance with the legislation in force since Decree n° 13.609/43, including the Companies Act, the Code of Civil Procedures, the Criminal Code and Law n° 8934/94 (Public Registration of Commercial Companies Act), only sworn public translators and commercial interpreters, duly enrolled at the Trade Board, have legal powers to perform sworn translations under their personal responsibility, attesting as authorities in the national territory.
